Privacy Policy & Legal Disclaimer for Counsellors

This policy applies to independent counsellors offering services via The Mind Moment platform. By engaging with this platform, you agree to abide by these terms and accept full responsibility for your professional conduct and data handling practices.

1. Scope of Practice

You must practice within the limits of your training and your country’s regulations. Do not present yourself as a therapist or psychologist unless licensed in the client’s country. You are responsible for your own legal compliance.

2. Independent Relationship

The Mind Moment is a connecting platform — we do not employ, oversee, or supervise any counsellor. All service delivery is your sole responsibility.

3. Data Collection Responsibilities

As a counsellor, you may collect:

• Client’s name, email, location (for session context)
• Notes or intake answers (only if relevant and consented)

You must:

• Collect data only with informed written consent
• Store it securely (encrypted/cloud-based)
• Delete data after 5 years or on request
• Never share client data without permission

4. Privacy Compliance

If supporting Canadian clients, you are expected to follow Canadian privacy standards under PIPEDA. All data must be handled with integrity, transparency, and confidentiality.

5. Not a Clinical or Emergency Platform

The Mind Moment is not a crisis or medical care service. Counsellors must inform clients that they do not provide:

• Medical diagnosis
• Prescription or treatment
• Emergency support

Refer clients to Talk Suicide Canada or 911 if needed.

6. Legal Disclaimer

The Mind Moment assumes no liability for your sessions or actions. You agree to indemnify us from any claims, damages, or disputes that arise from your services, including but not limited to:

• Client complaints or harm
• Misrepresentation of your services
• Data privacy violations

7. Consent & Acknowledgement

Before working with any client through our platform, you must ensure they:

• Understand your role (wellness provider, not therapist)
• Have consented to session terms and data collection
• Know this is not medical or regulated therapy
